Terms of service

These Terms of Service establish the conditions governing the use of the MULPOTENOWA online store (https://mulpotenowa.com, the “Website”), operated by MULPOTE (“we,” “us,” or “our store”).

Customers who use the Website (“customers” or “you”) must use it only after agreeing to these Terms.

Article 2 — Products

All products sold by our store are made to order after an order has been received.

Products are not shipped from existing inventory.

Article 3 — Formation of the Sales Contract

  2. Notwithstanding the preceding paragraph, we may decline an order or cancel a contract after it has been formed if any of the following circumstances apply. In such cases, any amount already paid will be refunded:

    1. We reasonably determine that the customer has violated or may violate these Terms.

    2. The information provided by the customer contains false information, errors, or omissions.

    3. The manufacture or delivery of the product becomes difficult due to circumstances beyond our reasonable control.

    4. We reasonably determine that the order was placed for commercial resale.

    5. The order was placed by a customer who has previously violated these Terms or engaged in similar misconduct.

    6. We otherwise reasonably determine that accepting the order would be inappropriate.

Article 4 — Prices and Payment

  1. Product prices are the amounts displayed on the relevant product pages and include consumption tax. Shipping fees are not included in the product prices.

  3. If payment processing fees or similar charges apply, responsibility for those charges will be determined as indicated on the Website.

Article 5 — Delivery of Products

  3. We are not responsible for a product failing to arrive due to incorrect or incomplete delivery information entered by the customer. Such cases will be handled in accordance with our Returns and Exchanges Policy.

  3. Purchasing a product does not transfer to the customer any intellectual property rights relating to the design used on that product.

  4. Notwithstanding the preceding paragraph, customers are free to wear purchased products for personal use and post photographs of those products on social media or similar platforms.

Article 8 — Prohibited Conduct

When using the Website, customers must not engage in any of the following conduct:

  3. Conduct that infringes the intellectual property rights, reputation, privacy, or other rights or interests of our store, another customer, or a third party

  4. Conduct that interferes or may interfere with the operation of the Website

  5. Unauthorised access or attempted unauthorised access

  6. Registration or submission of false information

  7. Impersonation of another person

  8. Commercial resale of our products without our prior written consent

  9. Any other conduct that we reasonably consider inappropriate

Article 10 — Liability

Where we are liable for damages, our liability will be limited to ordinary and reasonably foreseeable damages and will not exceed the amount paid by the customer for the product that caused the loss or damage. This limitation does not apply in cases of our intentional misconduct or gross negligence.

  4. Our responsibility for defective or non-conforming products is governed by our Returns and Exchanges Policy.

  5. If the customer qualifies as a “consumer” under Japan’s Consumer Contract Act, this Article will not apply to the extent that excluding or limiting our liability is prohibited by that Act or any other applicable law.
